Subject: Payment of Dearness Allowance to Central Government employees - Revised Rates effective from 1.1.2014.
The undersigned is directed to refer to this Ministry’s Office Memorandum No.I-8/2013-E-II (B) dated 25th September, 2013 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 90% to 100% with effect from January, 2014.

2. The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M. No.1(3)/2008-E-11(B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.
3. The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.
4. The payment of arrears of Dearness Allowance shall not he made before the date of disbursement of salary of March. 2014.
5. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees, separate orders will he issued by the Ministry of Defence and Ministry of Railways, respectively.
6. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Association impact : Minimum working experience in Postal / RMS wing orders withdrawn by Postal Directorate

Postal Directorate vide Memo No. 25-02/2001-PE-I dated 20th March 2014 has withdrawn the orders issued regarding compulsory minimum working experience in Postal / RMS wing for IPs and ASPs before their higher promotions issued under letter dated 9th September 2013.

All are aware that CHQ has objected this issue vide their letter No. GS/AIAIASP/Merger/IP-ASP/2013 dated 21.09.2013, 17.10.2013 & 06.01.2014. Besides this, as per the directions from Secretary (Posts) the issue was also discussed with Member (P) and DDG (Estt) at length on 27th November 2013 and thereafter Department has called for fresh views / comments from all HOCs and now decided to withdraw the mandatory condition of service made essential vide Postal Directorate memo No. 25-02/2001-PE-I dated 9th September 2013.

Revision of monetary limits for handling cases of Loss / Fraud cases for conducting Investigations at DO/RO/CO level

Postal Directorate vide letter No. 8-03/2012-INV dated 24.03.2014 has revised the monetary limits for handling cases of Loss / Fraud cases for conducting Investigations at DO/RO/CO level.
 
The revised limits will be applicable for cases detected on or after 01.04.2014. Earlier limits will be applicable in respect of all investigations pending on 31.03.2014.

Income Tax is an annual tax on income. The Indian Income Tax Act (Section 4) provides that in respect of the total income of the previous year of every person, income tax shall be charged for the corresponding assessment. Paying income tax is mandatory for all citizens whose gross total income - which includes income from salary, business, capital gains, property and other sources, before allowing for deductions - exceeds the basic exemption limit.

It has been reported by CS Kerala Circle that, our upgradation of GP case (OA No. 289/13) came up before the Hon'ble CAT Ernakulam Bench  on 12/3/2014 for disposal / orders. Considering the submission of our Counsel, the case has been adjourned to 7/4/2014 for filing rejoinder. As per the decision taken in AIC Ahmedabad we have already forwarded the draft rejoinder to Counsel for preparation of final draft and submission.

Renewal of CGHS plastic cards in Delhi NCR - regarding.

Sub: Renewal of CGHS plastic cards in Delhi NCR - regarding.

The undersigned is directed to refer to this Ministry's 0.M No. S 11011/1/2014- CGHS (P) dated 10.02.2014 vide which fresh instructions were issued supplementing the existing guidelines on the issue of CGHS Plastic cards. In this regard attention is also drawn to this Ministry's O.M. No. Misc. 6024/2007/CGHS(HQ)/CGHS(P) dated 27.12.2010 in respect of pensioner CGHS beneficiaries vide which it was clarified that :-

"The Plastic Cards (which are identity cards), would hereinafter be issued with validity till the pensioner beneficiary is entitled for CGHS benefits. In respect of pensioner CGHS beneficiaries, who have paid CGHS contribution for 'Rest of Life' CGHS facilities, the Plastic Cards would, hereinafter, be issued for 'Rest of Life'.

The plastic cards already issued with a printed validity of five years to pensioner beneficiaries, who had paid CGHS contributions for 'Rest of Life' CGHS facilities, would be taken as valid for use for 'Rest of Life'. However, such CGHS pensioner beneficiaries have the option to obtain new plastic cards after five years, if they choose to do so."

2. Accordingly, the CGHS pensioner beneficiaries have the option to apply for new CGHS plastic card which are now being issued with validity for 'whole life' printed on the plastic card itself. However, the serving employees are issued CGHS plastic cards with validity of five years and they are due for renewal every five years on expiry of validity period indicated on their CGHS plastic card. Fresh cards are being issued in place of old cards on regular basis. Since the applications are being received for renewal of old cards in a very large number, it has created bottleneck and it is taking some time to issue fresh cards.

3. In light of the above, with a view to avoid inconvenience to the CGHS beneficiaries and to facilitate them in availing CGHS services, it has been decided to allow them to access CGHS facilities with the old cards for a further period of six months from the date of expiry of CGHS cards as indicated on their CGHS Plastic cards. However, they have to apply for renewal of CGHS plastic card in the prescribed Form as provided in this Ministry's OM dated 10.02.2014 as referred to above.

4. In this connection, it is clarified that the beneficiaries who have already submitted applications for renewal of CGHS cards on expiry of their validity period and have so far not received fresh CGHS cards, they will not be denied CGHS facilities, provided the beneficiary is entitled to CGHS benefits as per CGHS guidelines.

5. A CGHS beneficiary is required to apply for new CGHS plastic cards three months in advance or within six months of expiry of validity of the plastic cards and it is recommended to keep a copy of the same as a proof of submission of application for renewal of card which can be produced on demand before the CGHS authorities, if required, for availing the CGHS benefits on the basis of old card.

6. CGHS Wellness Centres will provide the medical facilities to CGHS beneficiaries on the basis of old CGHS plastic card upto a maximum period of six months from the date of validity as indicated on the CGHS plastic card after due verification of the entitlement and validity of CGHS card as per CGHS data base.

7. The CGHS empanelled private hospitals / diagnostic centres are requested to provide the medical facilities on the basis of old card upto a maximum period of six months from the date of validity as indicated on the CGHS plastic card, subject to the condition that the CGHS beneficiary has submitted the application for renewal of CGHS plastic card, complete in all respect, to the CGHS card issuing authority.

8. This OM shall come into effect from the date of issue and will remain in force for one year or till further order, whichever is earlier.

No LDCE for the promotion to the cadre of PS Gr. B

Dear Members,

It is learnt that Department is still receiving lot of CAT / Court cases i/c/w declaration of results of previous years PS Gr. B examinations.
 
It is also learnt that to avoid CAT/Court cases in future, Department is in opinion to make some changes in the examination pattern / syllabus etc. Therefore department has not hold examination in 2013.
 
Secondly, revised Recruitment Rules of PS Gr. B cadre are under preparation and for that some creation memos are required to produce before Nodal Ministry. It is therefore once again requested to all members/all Circle Secretaries/CHQ Office bearers (except HP/Odisha/Kerala circles) to search the creation memos of PS Gr. B posts in their circle since 1993 and report to CHQ without awaiting further reminder.

Revision of Interest Rates for Small Savings Schemes for the Financial Year 2014-15 Announced

Various decisions taken by the Government of India on the recommendations of the Shyamala Gopinath Committee for Comprehensive Review of National Small Savings Fund (NSSF), were communicated to all concerned by the Government through its Office Memorandum dated 11th November, 2011.
 
            One of the decisions of the Government based on the recommendations of the Committee relates to revision of interest rates every financial year, to be notified before 1st April of that year.  Accordingly with the approval of the Finance Minister, the rates of interest on various small savings schemes for the Financial Year 2014-15 effective from 01.04.2014, on the basis of the interest compounding/payment built-in in the schemes, shall be as under :

Terms of Reference of the Sixth Central Pay Commission

A. To examine the principles, the date of effect thereof that should govern the structure of pay, allowances and other facilities/benefits whether in cash or in kind to the following categories of employees :-

1. Central government employees – industrial and non-industrial.
2. Personnel belonging to the All India Services.
3. Personnel belonging to the Armed Forces.
4. Personnel to the Union Territories.
5. Officers and employees of the Indian Audit and Accounts Department.
6. Members of the regulatory bodies (excluding the RBI) set up under Acts of Parliament*.
7. Officers and employees of Supreme Court of India**.

B. To transform the Central Government Organisations into modern, professional and citizen-friendly entities that are dedicated to the service of the people.

C. To work out a comprehensive pay package for the categories of Central Government employees mentioned at (A) above that is suitably linked to promoting efficiency, productivity and economy through rationalization of structures, organizations, systems and processes within the government, with a view leveraging economy, accountability, responsibility, transparency, assimilation of technology and discipline.

D. To harmonize the functioning of the Central Government Organisations with the demands of the emerging global economic scenario. This would also take in account, among other relevant factors, the totality of benefits available to the employees, need of rationalization and simplification, thereof, the prevailing pay structure and retirement benefits available under the Central Public Sector Undertakings, the economic conditions in the country, the need to observe fiscal prudence in the management of the economy, the resources of the Central Government and the demands thereon on account of economic and social development, defence, national security and the global economic scenario, and the impact upon the finances of the States if the recommendations are adopted by the States.

E. To examine the principles which should govern the structure of pension, death-cum-retirement gratuity, family pension and other terminal or recurring benefits having financial implications to the present and former Central Government employees appointed before January 1, 2004.

F. To make recommendations with respect to the general principles, financial parameters and conditions which should govern payment of bonus and the desirability and feasibility of introducing Productivity Linked Incentive Scheme in place of the existing ad hoc bonus scheme in various Departments and to recommend specific formulae for determining the productivity index and other related parameters.

G. To examine desirability and the need to sanction any interim relief till the time the recommendations of the Commission are made and accepted by the Government. *A. vi substituted by Ministry of Finance Resolution No.5/2/20006-E.III (A) dated the 7th December, 2006. **A. vii substituted by Ministry of Finance Resolution No.5/2/2006-E.III (A) dated the 8th August, 2007.

The Commission will devise its own procedure and may appoint such Advisers, institutional consultants and experts, as it may consider necessary for any particular purpose. It may call for such information and take such evidence, as it may consider necessary. Ministries and Departments of the Government of India will furnish such information and documents and other assistance as may be required by the Commission.

The Government of India trusts that State Governments, Service Association and others concerned will extend to the Commission their fullest cooperation and assistance. The Commission will have its headquarters in Delhi.

The Commission will make its recommendations within 18 months of the date of its constitution. It may consider, if necessary, sending reports on any of the matters as and when the recommendations are finalized.

Terms of Reference of the 7th Central Pay Commission

The Union Cabinet today gave its approval to the Terms of Reference of 7th Central Pay Commission (CPC) as follows:-
a) To examine, review, evolve and recommend changes that are desirable and feasible regarding the principles that should govern the emoluments structure including pay, allowances and other facilities/benefits, in cash or kind, having regard to rationalization and simplification therein as well as the specialized needs of various Departments, agencies and services, in respect of the following categories of employees:-
i. Central Government employees-industrial and non-industrial;
ii. Personnel belonging to the All India Services;
iii. Personnel of the Union Territories;
iv. Officers and employees of the Indian Audit and Accounts Department;
v. Members of regulatory bodies (excluding the Reserve Bank of India) set up under Acts of Parliament; and
vi. Officers and employees of the Supreme Court.

b) To examine, review, evolve and recommend changes that are desirable and feasible regarding principles that should govern the emoluments structure, concessions and facilities/benefits, in cash or kind, as well as retirement benefits of personnel belonging to the Defence Forces, having regard to historical and traditional parities, with due emphasis on aspects unique to these personnel.

c) To work out the framework for an emoluments structure linked with the need to attract the most suitable talent to Government service, promote efficiency, accountability and responsibility in the work culture, and foster excellence in the public governance system to respond to complex challenges of modern administration and rapid political, social, economic and technological changes, with due regard to expectations of stakeholders, and to recommend appropriate training and capacity building through a competency based framework.

d) To examine the existing schemes of payment of bonus, keeping in view, among other things, its bearing upon performance and productivity and make recommendations on the general principles, financial parameters and conditions for an appropriate incentive scheme to reward excellence in productivity, performance and integrity.

e) To review the variety of existing allowances presently available to employees in addition to pay and suggest their rationalization and simplification, with a view to ensuring that the pay structure is so designed as to take these into account.

f) To examine the principles which should govern the structure of pension and other retirement benefits, including revision of pension in the case of employees who have retired prior to the date of effect of these recommendations, keeping in view that retirement benefits of all Central Government employees appointed on and after 01.01.2004 are covered by the New Pension Scheme (NPS).

g) To make recommendations on the above, keeping in view:
i. the economic conditions in the country and need for fiscal prudence;
ii. the need to ensure that adequate resources are available for developmental expenditures and welfare measures;
iii. the likely impact of the recommendations on the finances of the State Governments, which usually adopt the recommendations with some modifications;
iv. the prevailing emolument structure and retirement benefits available to employees of Central Public Sector Undertakings; and
v. the best global practices and their adaptability and relevance in Indian conditions.

h) To recommend the date of effect of its recommendations on all the above. The Commission will make its recommendations within 18 months of the date of its constitution.

It may consider, if necessary, sending interim reports on any of the matters as and when the recommendations are finalised.

The decision will result in the benefit of improved pay and allowances as well as rationalization of the pay structure in case of Central Government employees and other employees included in the scope of the 7th Central Pay Commission.

Background
Central Pay Commissions are periodically constituted to go into various issues of emoluments’ structure, retirement benefits and other service conditions of Central Government employees and to make recommendations on the changes required.

7th Central Pay Commission

f) To examine the principles which should govern the structure of pension and other retirement benefits, including revision of pension in the case of employees who have retired prior to the date of effect of these recommendations, keeping in view that retirement benefits of all Central Government employees appointed on and after 01.01.2004 are covered by the New Pension Scheme (NPS).

g) To make recommendations on the above, keeping in view:

i.    the economic conditions in the country and need for fiscal prudence;

ii. the need to ensure that adequate resources are available for    developmental expenditures and welfare measures;

iii.   the likely impact of the recommendations on the finances of the State Governments, which usually adopt the recommendations with some modifications;

iv.  the prevailing emolument structure and retirement benefits available to employees of Central Public Sector Undertakings; and

v.   the best global practices and their adaptability and relevance in Indian conditions.

h) To recommend the date of effect of its recommendations on all the above.

The Commission will make its recommendations within 18 months of the date of its constitution. It may consider, if necessary, sending interim reports on any of the matters as and when the recommendations are finalised.

The decision will result in the benefit of improved pay and allowances as well as rationalization of the pay structure in case of Central Government employees and other employees included in the scope of the 7th Central Pay Commission.
